1. Acceptance of Terms

By accessing or using WebBeaverPro ("WebBeaverPro," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must immediately discontinue use of the Service.

2. Eligibility

You must be at least 18 years old (or the legal age of majority in your jurisdiction) to use the Service.

3. Description of Service

WebBeaverPro provides a hosted website-building platform, including tools, hosting, and related services ("Service"). We reserve the right to modify, update, or discontinue any aspect of the Service at any time.

4. Accounts and Responsibility

  • You are solely responsible for your account and all activity under it.
  • You must provide accurate and current information at all times.
  • You are responsible for securing your login credentials.

We are not liable for unauthorized access resulting from your failure to secure your account.

5. User Content and Responsibility

You retain ownership of your content. You grant WebBeaverPro a worldwide, non-exclusive, royalty-free license to host, use, reproduce, modify, and display your content solely for the purpose of operating the Service.

You are fully responsible for your content and agree that it will not:

  • Violate any applicable law or regulation
  • Infringe the intellectual property rights of any third party
  • Contain harmful, abusive, or illegal material

6. Absolute Rights of Enforcement

Key Clause: WebBeaverPro reserves the absolute and unrestricted right, at its sole discretion, to suspend or permanently terminate any account, delete or disable access to any content, or restrict access to the Service — at any time, with or without notice, and for any reason.

This includes but is not limited to:

  • Suspected violations of these Terms
  • Legal risk or exposure
  • Platform abuse
  • Operational, security, or business considerations

You acknowledge that WebBeaverPro shall not be liable for any loss of data, revenue, or business resulting from such actions.

7. Service Modification and Discontinuation

We reserve the unrestricted right to modify, limit, or discontinue the Service (or any part of it), change features, pricing, or functionality, or shut down the platform entirely. These actions may be taken at any time, with or without notice.

8. Data Retention and Deletion

  • We are under no obligation to store, maintain, or provide backups of user data.
  • Data may be permanently deleted upon account suspension, termination, or service discontinuation.

Users are solely responsible for maintaining their own backups.

9. Fees and Payments

  • Certain features of the Service require payment.
  • All fees are non-refundable, except where required by applicable law.
  • We may change pricing at any time.

Failure to pay may result in immediate suspension or termination of your account.

10. Intellectual Property

All rights, title, and interest in the Service (excluding User Content) remain the exclusive property of WebBeaverPro. You may not:

  • Copy, resell, or otherwise exploit the platform
  • Reverse engineer or attempt to extract source code
  • Use the Service to build a competing product

11. Third-Party Services

The Service may integrate with third-party tools and services. We are not responsible for the availability, content, or failures of any third-party services.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including but not limited to warranties of availability, uptime, accuracy, reliability, or fitness for a particular purpose. Use of the Service is entirely at your own risk.

13. Limitation of Liability

To the maximum extent permitted by law, WebBeaverPro shall not be liable for loss of profits, revenue, or data, business interruption, or any indirect, incidental, or consequential damages.

Total liability shall not exceed the amount paid by the user (if any) in the preceding 30 days.

14. Indemnification

You agree to indemnify and hold harmless WebBeaverPro, its owners, and affiliates from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms.

15. Changes to Terms

We reserve the right to update these Terms at any time without prior notice. Continued use of the Service following any update constitutes your acceptance of the revised Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Jamaica, without regard to conflict of law principles.
